Good Day, Madam President,
On March 26, our consumer group wrote PIPPA a letter on the matter of Covid 19 and ECQ as Force Majeure. While your office acknowledged receipt of the letter by email, as of date, regrettably, there is no reply from your Association.
This week, Meralco released its April power rate press statement and informed that Meralco had invoked Force majeure as per PSA contract to bill consumers the least cost. The April rate report covered 10 days of the lockdown period and solely for the supply of the month of March. The full 30 day lockdown shall be reported in the May rate report. We believe the bigger relief of pkwh shall be passed on to the consumers at that time.
We are writing PIPPA to ensure that Gencos accept the Force Majeure claim of Meralco and other utilities and cooperatives, which availed of remedies available under ERC approved PSA to protect consumers.
